These Terms of Service ("Terms") govern your access to and use of MarketOne — the marketone.io website, the MarketOne application, and any related tools, data, content, and services (together, the "Service") — operated by Leachman Holdings LLC ("Leachman Holdings," "MarketOne," "we," "us," or "our"). MarketOne is a product of Leachman Holdings LLC, and "we," "us," and "our" include Leachman Holdings LLC together with its affiliates and subsidiaries. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements and that your use complies with all laws that apply to you.
2. The Service
MarketOne provides market data, calendars, screeners, charts, indicators, educational material, and automatically generated market content, along with related account and communication features. The Service is provided for informational and educational purposes only and is not investment advice — see our Disclaimers. We may add, change, suspend, or remove features at any time.
These Terms cover this informational Service. Any brokerage, investment-advisory, or trade-execution service we may offer in the future — including any connection to a third-party broker — will be governed by a separate agreement that you accept separately, and is not provided under these Terms.
3. Accounts
Some features require an account. You agree to provide accurate information, to keep it current, and to keep your credentials secure. Authentication may be handled by a third-party provider on our behalf. You are responsible for all activity under your account, and you agree to notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.
4. Acceptable use
You agree not to:
- use the Service in violation of any law or regulation, or for any unlawful or fraudulent purpose;
- scrape, harvest, or bulk-download data except through means we expressly provide, or exceed rate limits or other technical restrictions;
- resell, redistribute, sublicense, or commercially exploit any data or content from the Service without our written permission;
- reverse engineer, decompile, or attempt to derive the source code of the Service, except where such a restriction is prohibited by law;
- interfere with, disrupt, or place undue load on the Service, or attempt to gain unauthorized access to any system or account;
- remove or obscure any proprietary notices, or misrepresent your affiliation with MarketOne.
5. Intellectual property
The Service and its contents — including software, text, graphics, logos, and the selection and arrangement of data and content — are owned by MarketOne or its licensors and are protected by intellectual-property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own personal, non-commercial purposes. All rights not expressly granted are reserved.
6. Third-party data and services
The Service relies on data and services from third parties, including exchanges, data vendors, and infrastructure providers. Your use of third-party data may be subject to those providers' terms, and we make no warranty regarding it. We are not responsible for third-party websites, products, or services that the Service links to or integrates with.
Where the Service offers a connection to a third-party broker or financial account — for example, to link, view, or transmit instructions to an account you hold elsewhere — that broker or provider, not MarketOne, executes transactions and holds your funds and securities, and your use of the connection is subject to that provider's own agreement. You are responsible for the instructions you submit through any such connection.
7. Feedback
If you send us ideas, suggestions, or other feedback about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use it for any purpose without obligation to you.
8. No investment advice
Nothing on the Service is investment, financial, legal, or tax advice, and MarketOne is not your broker, adviser, or fiduciary. You are solely responsible for your own decisions. Please read our Disclaimers in full before acting on any content.
9. Paid features
Certain features may be offered on a paid or subscription basis. When they are, the applicable prices, billing terms, renewal, cancellation, and refund policies will be presented to you at the point of purchase and form part of these Terms. Unless stated otherwise, subscriptions renew automatically until cancelled, and fees are non-refundable except where required by law. Payments may be processed by a third-party payment provider, and you authorize us and that provider to charge your selected payment method.
10. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY REGARDING THE ACCURACY, COMPLETENESS, OR AVAILABILITY OF DATA OR CONTENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MARKETONE AND ITS OFFICERS, EMPLOYEES, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS (US$100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless MarketOne and its officers, employees, and licensors from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.
13. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, including for any violation of these Terms. You may stop using the Service at any time. Provisions that by their nature should survive termination — including intellectual-property, disclaimer, liability, and indemnification provisions — will survive.
14. Changes to these Terms
We may update these Terms from time to time. Changes are effective when posted, and the "Last updated" date above reflects the most recent revision. If a change is material, we will make reasonable efforts to notify you. Your continued use of the Service after a change means you accept the revised Terms.
15. Governing law and disputes
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Wyoming, and you consent to the personal jurisdiction of those courts. Before filing any claim, you agree to first contact us and attempt to resolve the dispute informally in good faith.
16. General
These Terms, together with the Privacy Policy and Disclaimers, are the entire agreement between you and MarketOne regarding the Service. If any provision is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for any failure or delay caused by events beyond our reasonable control.
